I am assuming o n behalf of myself and/or my child/ward\, all risk of personal injury\, de ath\, or disability to myself and/or my child/ward that may result from pa rticipation\, and any damage\, loss or theft of any personal property whic h may occur to me and/or my child/ward. I understand that the MIFITNESS fa cilities have playground equipment and that using the equipment may pose i nherent risks\, which include the risk of serious physical injury and/or d eath. Further\, I have explained these risks to my child/ward. Despite the risks mentioned above\, I freely want to participate and as such\, I assu me all the risk and responsibility for any injury\, death or disability th at may result. \;WAIVERI understand that I and/or my child/ward will b e engaging in recreational and sporting activities while using the MIFITNE SS PTY LTD facilities and it is my voluntary and informed decision to waiv e any liability\, legal action or claim that may arise against the Release es set out below. Therefore\, I agree on behalf of myself and my child/war d and our personal representative\, successor\, heirs\, and assigns to hol d MIFITNESS and its shareholders\, affiliates\, instructors\, officers\, d irectors\, agents\, employees\, designers\, licensors\, and members\, as w ell as the property owner and tenants of the property and owners\, manufac turers and installers of the equipment comprising the MIFITNESS PLAY PARK facility (collectively\, the “Releasees”) harmless from any and all cl aims or causes of action arising out of my and/or my child/ward’s partic ipation at the MIFTINESS facilities\, including any such claims for neglig ence. \;I expressly indemnify and hold harmless the Releasees from any and all liability\, claims\, demands or causes of action whatsoever arisi ng out of any damage\, loss\, personal injury\, or death to me or my child /ward\, while participating in any of the activities offered at the MIFITN ESS facilities. This includes\, without limitation\, use of playground equ ipment\, receiving instruction\, strenuous bodily movement\, and any other activities in and around the MIFITNESS facilities. This release and indem nity are valid and effective whether the damage\, loss\, or death is a res ult of any act or omission on the part of any Releasees or from any other cause. This Waiver includes\, but is not limited to\, death\, injuries\, o r accidents\, which may occur as a result of the: (a) use or misuse of the facilities in any way by anyone\, (b) use of any equipment that malfuncti ons or breaks\, (c) improper maintenance of the facilities\, grounds\, or any equipment\, (d) instruction or supervision\, or (e) slipping\, trippin g\, and/or falling while in the facilities or on the surrounding premises. This may include any losses suffered as a result of using the parking are as or amenities in and around the MIFITNESS Facilities. \;Any claims a rising from the use of the MIFITNESS facilities shall be governed by the L aws of South Africa. \;I and/or my child/ward am in good physical cond ition for the activity in which I and/or my child/ward will be participati ng and certify that I and/or my child/ward do not have any medical conditi on that may preclude me and/or my child/ward from safely participating.&nb sp\;I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS WAIVER AND TERMS AND CON DITIONS CONTAINED HEREIN AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY AND A WAIVER OF ANY RIGHTS THAT I MAY HAVE ON BEHALF OF MYSELF A ND/OR MY CHILD/WARD TO BRING LEGAL ACTION OR ASSERT A CLAIM FOR DEATH\, IN JURY OR LOSS OF ANY KIND AGAINST THE RELEASEES.
