Alberta's Eugenics Legacy & the Notwithstanding Clause
The Notwithstanding Clause has been used by the Alberta Government four times in the past year to override the Charter rights of teachers and trans people. And yet, the history of the Notwithstanding Clause in Alberta is much longer. Come hear about the first time the Alberta Government tried to use the Notwithstanding Clause, in 1998, to override survivors of Alberta's eugenics program, and the lessons that one might derive from this historical episode about how to resist government intrusions into legal rights.
Anna Lund is a professor in the Faculty of Law at the University of Alberta where her teaching and research interests include housing law, debtor-creditor law, and civil litigation. She carries on a pro bono legal practice and has appeared at the Supreme Court of Canada and the Saskatchewan Court of Appeal as co-counsel for British Columbia Civil Liberties Association on cases about the scope of the Notwithstanding Clause.
