Simone considers: where to draw the line between acceptable use of AI and unacceptable risk, how verification should be undertaken in practice, how to supervise junior lawyers’ use of AI, how to protect confidentiality and privilege, and how to ensure the firm’s position remains defensible if scrutinised. While most firms now have, or are developing, AI policies, the greater challenge lies in their practical application. This ultimately turns on judgement and effective supervision, particularly where junior lawyers are using AI under time pressure, which is often where the greatest risk arises.
